President Obama has repeatedly promised to repeal the Defense of Marriage Act (DOMA), which defines marriage as “a legal union between one man and one woman as husband and wife for the purpose of all federal laws.” Knowing that a clear majority of Americans would oppose a legislative repeal of DOMA, the president and Congress are using alternative tactics to systematically attack the institution of marriage while dismantling the federal DOMA law piece by piece. These efforts include:
- President Obama nominating individuals to serve on federal courts who believe there is a constitutional right to same-sex marriage in the U.S. Constitution and oppose DOMA;
- The U.S. Census Bureau instructing same-sex couples to report themselves as married if they feel they are married – even in the 30 states that have constitutional amendments protecting marriage as the union of a man and a woman;
- A U.S. House committee recently drafting – and then retracted -- forms that recognize same-sex couples as "spouses" for the purpose of completing financial disclosure paperwork for elected officials and senior congressional staffers – another direct violation of DOMA.
- The president ordering the Department of Health and Human Services to investigate and recommend actions regarding “hospital visitation, medical decision-making, or other health care issues that affect” specifically for homosexual, bisexual or transgender individuals but notably excluding other non-married persons.
In light of these attacks on marriage, CitizenLink has launched a new citizen petition, “Stand for Marriage.” We are calling on 250,000 CitizenLink Action team members to sign our new petition in the next few weeks so we can immediately respond to these blatant efforts to undermine DOMA and establish same-sex marriage at the federal level. About the Petition:
Since the 2006 election, Congress has been working to pass legislation that would threaten employers' and employees' freedom of religion, speech and association. The Employment Non-Discrimination Act (ENDA) elevates homosexuality and transgenderism to a protected status in employment, which unfairly places burdens on employers' hiring decisions and on the ability of employees to share their beliefs about God's design for human sexuality, marriage and family.
If passed, ENDA would grant the same protections to sexual behavior and "gender expression" that is currently granted to race, creed, color and national origin – which would have dramatic and far-reaching effects on the workplace, perhaps even for faith-based organizations like Citizen Link Action. ENDA would:
- Violate employers' and employees' constitutional freedoms of religion, speech and association;
- Place unfair burdens on employers to know about their employees' and applicants' sexual self-identity and behavior and take that into consideration in employment decisions;
- Require employers, perhaps even faith-based organizations like Citizen Link Action, to hire people who self-identify as homosexual or transgender or others who are hostile to the organization's deeply held religious beliefs;
- Impact employees' freedom to hold and share beliefs about God's design for human sexuality that do not embrace homosexuality and transgenderism; and
- Force employers to spend money defending against lawsuits if employees allege discrimination.
